_{By ordering a commission, you must read and agree with the following terms and conditions :}Commission process & Payment- When my commissions are open, you'll be able to send a request via a Google Form or via VGen (the link will be provided in my advertizing post).- My commissions are usually not first come, first served : I would contact you if I accept your request.- I will request your PayPal e-mail to send a PayPal invoice. This e-mail address will not be stored and it serves for invoicing only.- Payment must be sent via PayPal only, in USD, unless stated otherwise.- Please wait for my approval before sending any payment.- Payment must be made upfront in full before I can start working on the commission.- If the payment is not made within one week of the submission form being approved, I reserve myself the right to cancel the commission. The client, however, may still send in another form at the next commissions opening.- I reserve myself the right to negotiate extra fees, depending on the character’s design complexity (the fee range is explicitly mentioned in my commission information).- I reserve myself the right to decline or cancel a commission for any reason.
If the payment has already been made, the client will receive a full refund.- All communication between the client and I must be respectful. If you need an update on your commission, please ask me politely.- To ensure good communication, the client should be able to reply to my messages in a delay of 7 days. Past this delay, I may cancel the commission and give the client a partial refund.- You can check my progress on commissions on Trello.Refund Policy- After I’ve sent you the finished result of your commission : no refund.
If you need changes to be done, ask me politely ; do not edit the artwork yourself.- If I have already started your commission : 50% refund.- If I haven’t started your commission : full refund.Rights & Ownership
General rules- Do not claim the commissioned artwork as your own creation.- Do not edit my artwork under any circumstance unless I have explicitly allowed you to.- Do not remove my watermark/signature.- Do not sell, trade, or use the commission for profit unless you paid for commercial rights, see below.- You have the right to upload the commissioned artwork online, proper credit (my username or a link to my website/social media) would be very appreciated.- I reserve myself the right to use the commissioned artwork for promotion purposes and upload it on my social media, unless you request otherwise.- Do not create a NFT of my work.
- My art cannot be bought or sold for cryptocurrency or as NFTs.
- Do not use my work for AI generated pictures training.Specific Rules for Character Designs
_{By purchasing an adoptable from me, including closed species such as Faelans, you automatically agree to the following Terms of Service.}- - - What are adoptables ?_{An adoptable is a character design you can buy from an artist.
You may then name the character, create a personality and background story for them, draw them or even commission art of them 🌼}- - - Global rules
- You may modify the character's design, but please do NOT make those changes directly on my artworks.- Credit me when uploading your character.- Do not claim the original design and artwork as your own.- I will not remove my watermark or signature from my artwork.- You may co-own an adoptable, but I won't get involved if any troubles happen between the different parts.- Do not create a twin of the adoptable.- - - Resell Policy_{When reselling an adoptable created by me, the seller and the new owner must respect my own resell/trade policy : no other rule can override mine.}- The global rule is that an adoptable by me can be resold for the price you paid to adopt it.- If you commission art of the character with real money, you can resell it accordingly to its new monetary value.
_{· Say you bought an adoptable for 50$ and commissioned 100$ worth of art from another artist, you can resell the adopt for 150$.}- If you receive extra art of the character via trade/gift, you may add it to its trade value :
_{· Say you bought an adopt for 50$ and you receive extra artworks of the adoptable via trade/gift, then you can resell it for 50$ + ask for something else as a trade add-on (art, existing designs) of a matching value.}- If you want to resell a characters with extra artworks that you did yourself, the extra artworks count as trade value :
_{· Say you bought an adopt for 50$ and you drew 200$ worth of artworks of said adoptable, then you can resell it for 50$ + ask for something else as a trade add-on (art, existing designs) of a matching value.}- My designs can be traded/gifted ; vouchers are allowed.Commercial Use_{It is assumed that the client will make a personal use of the work purchased/commissioned.
If you want to use the file in a project that generates revenues, you will need to acquire one of the commercial licenses listed below, for each product you want to make a commercial use of.
Licenses are available for commissioned artworks and character designs.}_{Contact me via direct message on any of my platforms for commercial rights inquiries.}- License A : + 50% fee of base price of the file
allows : online self-publication of your work ; online advertizing of your work.- License B : + 100% fee of base price of the file
allows : physical & online self-publication of your work + physical & online advertizing of your work.- License C : + 150% fee of base price of the file
allows : physical & online self-publication of your work + advertizing and limited merch (online + printed, max 50/100 pieces per merch).- License D : + 300% fee of base price of the file
allows : Vtuber identity usage + physical & online self-publication/advertizing + merch, unlimited._{If you have a question about a use that is not listed above, please contact me.}General Data Protection- The PayPal e-mail of the customer is required in order to send PayPal invoices. Your details will not be sent to third parties or added to mailing lists.- None of the potential other personal data collected for commissions is stored. I, Johdaa, do not create or participate in any blockchain-related technology (including NFTs and cryptocurrency). If my work is used as such, I will respond with appropriate legal action and demand monetary compensation.Notes on AI generated pictures
I, Johdaa, do not generate AI pictures and my artworks should not be used to train generative Artificial Intelligence.
